SENDER H2020 mobile application
Terms of Use
The SENDER H2020 mobile application was designed and created to allow users to interact through an intuitive and user-friendly UI with the IoT equipment and smart appliances that were installed in the pilot sites under the European project: SENDER H2020. Through the application, the users can control and monitor house appliances under a common UI. In addition, they will get information about the demand desponse strategies that will take place on their premises as has been settled under the terms of the SENDER project. The scope of the application is the enhancement of the prosumers’ acceptance and engagement in SENDER project.
The SENDER mobile application is part of the project “SENDER” which has received funding from the European Union’s Horizon 2020 research and innovation program under grant agreement No 957755. The mobile application will be distributed and deployed in four different European countries: Finland, Austria, Spain and Greece.
SENDER H2020 mobile application securely displays information related the users home energy and power consumption as well as the electrical vehicle charging status. Exclusively used for controlling the users’ HVAC system and Domestic Hot Water appliances according to the terms specified in the SENDER H2020 Privacy notice.
This mobile application addresses only the people that participate in the demonstration activities of the SENDER H2020 project that have installed the SENDER BOX in their premises.
The application is licensed and governed by the license terms as mentioned in these Terms of Use.
1. Acceptance of Terms of Use
Please note that your use of and interaction with the SENDER H2020 application is subject to these Terms of Use and the SENDER H2020 Privacy Notice, and by using and interacting with the application you agree to their applicability. These Terms of Use give you the right to use and interact with the Services. These Terms of Use and the SENDER H2020 Privacy Policy remain in full force and effect so long as you continue to use or access the Services, or until terminated earlier in accordance with the provisions of these Terms of Use. If you do NOT agree to all of these Terms of Use, you should NOT access or use the Services.
2. Modification of Terms
These Terms of Use may be amended by SENDER H2020 project at any time. Such amended Terms of Use shall be effective upon posting. By continuing to access or use the application and services after such posting, you will be deemed to have accepted such amendments. You are advised to regularly review any applicable terms and conditions.
SENDER H2020 project reserves the right to discontinue or make changes or updates with respect to the application and Services at any time without notice. SENDER H2020 reserves the right to restrict, refuse or terminate access of any person to Services or any part thereof effective immediately without notice at any time and for any reason whatsoever at its sole discretion. SENDER H2020 has the sole right to shut down the Application and Services or any part thereof for any reason at any time without notice or consent. SENDER H2020 will have no responsibility or liability for failure to store or delete any Content and/or User Content Light- Collector submitted to the Application.
3. Privacy Policy
Personal information provided or collected through or in connection with the SENDER H2020 application and services shall only be used in accordance with SENDER H2020 Privacy Policy and respective Terms of Use incorporated herein.
SENDER H2020 Privacy policy applies to all personal data of consumers collected via the use of the SENDER H2020 Application.
Please be aware that the SENDER H2020 Application and its services are exclusively available for use within premises where the SENDER Box has been installed.
The application is making use and analyzing information collected from in house IoT installation, in house EV charging stations and in house Domestic Hot Water appliances. None of this information is used for any other purpose other than offering control of the HVAC and Domestic How Water appliances, as well monitor the electric vehicle charging status, ambient conditions, and energy consumption metrics within the home environment.
The data that are displayed through the SENDER H2020 mobile application are GDPR compliant, encrypted, and anonymized. At any time, the users decide to leave SENDER project and has the right to ask for data deletion then the data will no longer be available in the mobile application. User should remove the application as well.
4. Disclaimers
ALL CONTENT AND USER CONTENT (INCLUDING, WITHOUT LIMITATION, TEXT, IMAGES, GRAPHICS, LINKS, AND OTHER MATERIALS) ON THE APP AND PRODUCT SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE". SENDER H2020 PROJECT AND ITS SUBSIDIARIES, AFFILIATES, PARTNERS, AND LICENSORS HEREBY EXPRESSLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AS TO THE OPERATION OF THE APP AND SERVICES, THE CONTENT OR USER CONTENT. Neither SENDER H2020 project nor its subsidiaries, affiliates, partners and licensors warrants or makes any representations that (i) the Application and Services will meet your requirements, (ii) the Application and Services will be uninterrupted, timely, or error free, or (iii) the results that may be obtained from the use of the application and Services will be correct, complete, accurate, reliable, or otherwise meet your requirements.
SENDER H2020 project and its subsidiaries, affiliates, partners and licensors and shall have no liability for interruptions or omissions in Internet, network or hosting services.
5. Access to Services & Rights
SENDER H2020 project grants you the right to use the Application and Services solely for monitoring electrical consumption, electrical vehicle charging status and controlling your HVAC and Domestic How Water appliances through the smart equipment installed in your own property and on your own smart device. You are solely responsible for restricting access to your smart device(s) that can monitor and control the Product in your own property.
You acknowledge and agree that SENDER H2020 Application and Services contain proprietary and confidential information that is protected by applicable intellectual property and other laws and treaties.
You acknowledge and agree that you will not reverse compile, reverse engineer, disassemble or modify, copy, reproduce, distribute, or republish any part of the Application and Services nor create any derivate works. You shall be solely responsible for the regulations, policies and procedures of the servers or networks connected to the Services in the case of your attempt to gain unauthorized access, interference or disruption to such servers and networks. Any future release, update or other addition to functionality of the Services (if any) shall be subject to these Terms of Use.
To improve the performance of the Application and Services, SENDER H2020 project may develop patches, bug fixes, updates, upgrades, and other modifications “Updates”. You acknowledge and agree that SENDER H2020 project may update the Application and Services without requiring any additional consent or action from you, and you give full consent to SENDER H2020 project to perform these updates. If you do not want such Updates, your sole remedy is to cease using the Services altogether.
In addition to the above the Application Software is licensed free of charge and not sold to you. This Agreement grants you only the right to use the Application Software, but you do not acquire any rights, express or implied, in the Application Software other than those specified in these Terms of Use. SENDER H2020 project retains all right, title, and interest in and to the Application Software, including all patents, copyrights, trade secrets, and other intellectual property rights incorporated therein. The Software is protected by copyright laws, international treaty provisions, and other intellectual property laws. Except as provided otherwise herein, you shall not rent, lease, sublicense, sell, assign, loan, or otherwise transfer the Product Software. You may not remove or destroy any product identification, copyright notices, or other proprietary markings or restrictions from the Product.
6. Limitation of Liability
IN NO EVENT SHALL SENDER H2020 project OR ANY OF ITS SUBSIDIARIES, AFFILIATES, PARTNERS AND LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, SPECIAL OR INCIDENTAL OR OTHER DAMAGES RESULTING FROM, ARISING OUT OF OR IN CONNECTION WITH THE ACCESS, USE OF, OR INABILITY TO ACCESS OR USE THE APPLICATIONS AND SERVICES, THE CONTENT OR THE USER CONTENT.
7. Intellectual property rights
Copyright and all other proprietary rights in Content provided by SENDER H2020 project, its affiliates, subsidiaries and/or partners in the Application Software and Services all belong to SENDER H2020 project Limited and / or its partners.
8. Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of European Union. You agree to the non-exclusive jurisdiction of the courts in the European Union for any disputes, claim or cause of action arising out of, or relating to or in connection with these Terms of Use or your use of the Services, including any disputes relating to the existence or validity of these Terms of Use, provided that you agree to submit any such disputes, claims or causes of action exclusively to the courts of European Union.
